01Acceptance of Terms
By creating an account, subscribing to a plan, or otherwise accessing the PaySense platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
These Terms apply to all visitors, users, and organizations that access or use the Service. You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you are at least 18 years old and have the legal authority to enter into these Terms.
02Service Description
PaySense is a software-as-a-service (SaaS) platform for merchant processing statement analysis. The Service provides AI-powered fee extraction, interchange rate verification against published Visa and Mastercard tables, fee categorization, savings estimation, and branded PDF report generation.
The Service is available via web application at app.paysenseadvising.com. Features, functionality, and supported statement formats may change over time as we improve the platform.
03Accounts and Registration
To use the Service, you must create an account and provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorized access or use of your account.
Each legal entity (company, LLC, sole proprietorship, etc.) is limited to one organization account. Organization administrators are responsible for managing user access, roles, and permissions within their organization. All users within an organization share the organization's subscription and analysis credits.
04Subscription Plans and Billing
The Service is offered under the following subscription plans:

All plans include unlimited users within your organization. Subscription fees are billed monthly and charged on your subscription anniversary date. Analyses beyond your plan's included limit are billed as overage at the per-analysis rate for your plan at the end of each billing period.
Plan upgrades and downgrades take effect at the start of your next billing cycle. PaySense reserves the right to change pricing with at least 30 days' advance written notice. Price changes will not apply to the current billing period.
05Free Trial and Cancellation
PaySense may offer free trial periods at its discretion. Trial terms will be communicated at the time of enrollment. At the end of a trial, your account will convert to the selected paid plan unless you cancel before the trial expires.
You may cancel your subscription at any time from your account settings or by contacting support. Cancellation takes effect at the end of your current billing period — you will retain access to the Service until that date. No refunds are provided for partial billing periods.
After cancellation, your data (uploaded statements, analysis results, and reports) will be retained for 30 days to allow you to export it. After 30 days, all data associated with your account will be permanently deleted. You may request immediate deletion at any time by contacting support.
06Data Ownership and Privacy
You retain full ownership of all data you upload to the Service, including merchant processing statements, and all reports and analysis results generated from that data. PaySense does not claim any ownership rights over your data.
You grant PaySense a limited, non-exclusive license to process, store, and analyze your uploaded data solely for the purpose of providing the Service. This license terminates when you delete your data or close your account.
Statement text is sent to third-party AI providers (currently Anthropic) for analysis via API. Data sent to AI providers is processed in real time and is not retained by the provider after processing, nor is it used for model training.
All data is stored encrypted at rest and transmitted encrypted in transit using TLS/SSL. You control data retention settings from your account and may delete individual statements or all data at any time. For full details on how we collect, store, and protect your data, see our Privacy Policy.
07Acceptable Use
You agree to use the Service only for its intended purpose. You may not:
- Reverse engineer, decompile, disassemble, or otherwise attempt to extract the source code of the Service or any part thereof
- Use the Service for any illegal purpose or in violation of any applicable law or regulation
- Resell, sublicense, or redistribute access to the Service without prior written permission from PaySense
- Upload malicious files, viruses, or any content designed to compromise the security or integrity of the Service
- Upload documents that you do not have authorization to analyze
- Interfere with or disrupt the Service, its servers, or networks connected to the Service
- Use the Service to facilitate fraud, deceptive business practices, or misrepresentation to merchants
- Share your account credentials with unauthorized parties or allow third parties to access the Service through your account
08Intellectual Property
The Service, including its name, logo, design, features, user interface, analysis engine, algorithms, interchange reference data, and documentation, is the property of PaySense LLC and is protected by applicable intellectual property laws. All rights not expressly granted in these Terms are reserved.
Your subscription grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your internal business purposes during the term of your subscription.
You retain ownership of all data you upload and all reports generated from your data. You may use, distribute, and modify your reports without restriction.
09Disclaimer and Limitation of Liability
Analysis results provided by the Service are estimates generated through AI-powered extraction and classification. While we strive for accuracy, results should be verified by qualified professionals before being used as the basis for pricing decisions, contractual commitments, or financial representations. We do not guarantee that every fee will be correctly extracted or classified from every statement format.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
PaySense is not liable for any business decisions made based on analysis results. To the maximum extent permitted by law, PaySense's total aggregate liability for any claim arising from these Terms or the Service shall not exceed the total fees paid by you to PaySense in the twelve (12) months preceding the event giving rise to the claim.
In no event shall PaySense be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, use, goodwill, or other intangible losses, whether arising from contract, tort, negligence, strict liability, or otherwise.
10Service Level
PaySense targets 99.5% uptime for the Service, measured on a monthly basis, excluding scheduled maintenance windows. Scheduled maintenance will be communicated in advance via email or in-app notification when possible.
PaySense will use commercially reasonable efforts to restore service promptly in the event of unplanned downtime. PaySense shall not be liable for any damages or losses resulting from downtime beyond reasonable efforts to restore service. Force majeure events, third-party provider outages, and circumstances beyond our reasonable control are excluded from uptime calculations.
11Termination
Either party may terminate the subscription with 30 days' written notice to the other party. Written notice may be provided via email to the address associated with your account or to austin@paysenseadvising.com.
PaySense may suspend or terminate your access immediately, without prior notice, if you violate the Acceptable Use provisions of these Terms, engage in activity that threatens the security or integrity of the Service, or fail to pay applicable fees after notice and a reasonable cure period.
Upon termination, your right to access the Service ceases. Your data will be retained for 30 days to allow export, after which it will be permanently deleted in accordance with our data retention policy. You may request immediate deletion at any time.
12Changes to Terms
PaySense reserves the right to modify these Terms at any time. We will provide at least 30 days' advance notice of material changes by sending an email to the address associated with your account and by posting the updated Terms on this page with a revised "last updated" date.
Your continued use of the Service after the effective date of updated Terms constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must stop using the Service and cancel your subscription before the changes take effect.
13Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes arising from or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in the State of Florida, and you consent to the personal jurisdiction of such courts.
